A federal judge has ruled in favor of Delphi retirees and their motion to compel the Pension Benefit Guaranty Corporation (PBGC) to release documents surrounding their decision to cut pensions for some retired auto workers. PBGC gained control over those pensions in 2009 when GM filed for bankruptcy protection.
As a result of the filing, pension payments for non-union Delphi workers were cut 30 to 70 percent, while the pensions of retirees represented by the United Auto Workers and other unions were not.
The District Court judge ordered PBGC to turnover census information and other documents surrounding pension decisions by the end of September, including documents they had previously withheld as classified.
According to court documents, a request from Delphi retirees that the PBGC also pay for sanctions, costs and attorney’s fees accumulated in the four year old lawsuit was denied.
Following the courts order, Congressman Mike Turner, a senior member of the House Oversight and Government Reform Committee, released a statement saying the Treasury Department has acknowledged they will comply with the court order.
